The "Pocket Listing" Just Got Put on Notice: New Laws in WA and OR

This week, the "Pocket Listing" and the "Institutional Grab" hit a legislative wall. Governors in both Washington and Oregon have signed bills that fundamentally change how homes are marketed and sold. If you’re a broker in the Northwest, your playbook just changed.

Washington (SB 6091): Effective June 10, 2026, "Pocket Listings" are effectively illegal. You cannot market a property to an exclusive group (like an in-house "private" network) unless it is concurrently marketed to the general public. * The Penalty: It’s now a professional conduct infraction. Fines start at $500, but repeat offenders face license revocation.
Oregon (HB 4128): This one targets the "Billionaire Buy-up." Institutional investors (entities owning 2,500+ homes) are now barred from buying a single-family home unless it has been publicly listed for at least 90 days. * The Penalty: Oregon isn't playing around—civil penalties for violations can reach $250,000.
These laws are designed to force transparency. In Washington, the "exclusive club" model is dead. In Oregon, the "90-day head start" is now the law of the land for families competing against Wall Street.
Until next time,
Jeff.
